1. PURPOSE

These General Conditions regulate the acquisition of the products offered on the website www.antonioplaferrandiz.com, which is owned by GTD A.PLA FERRANDIZ (hereinafter, ANTONIO PLA FERRANDIZ).

The acquisition of any of the products implies full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Special Conditions that may be applicable when acquiring certain products.

These General Conditions may be modified without prior notification, therefore, it is advisable to carefully read their content before proceeding to acquire any of the products offered.

ANTONIO PLA FERRANDIZ reserves the right to decide, at any time, the products and/or services that are offered to Customers. In this way, ANTONIO PLA FERRANDIZ may, at any time, add new products and/or services to those currently offered. Likewise, ANTONIO PLA FERRANDIZ reserves the right to withdraw or stop offering, at any time, and without prior notice, any of the products offered.

Once inside www.antonioplaferrandiz.com, and to access the contracting of the different products, the User must follow all the instructions indicated in the purchase process, which will imply reading and accepting all the general and special conditions set in www.antonioplaferrandiz.com.

OBSERVATIONS

User registration is not mandatory, but it is possible to do so and thus speed up the process in subsequent purchases. Being registered also provides us with other possible advantages, such as promotional coupons.

5 AVAILABILITY AND SUBSTITUTIONS

PRODUCTS

ANTONIO PLA FERRANDIZ intends to guarantee the availability of all the products that are advertised through www.antonioplaferrandiz.com. However, in the event that any product requested is not available or if it has run out, the customer will be informed at the same moment of the purchase process, as soon as possible.

If the product is not available, and the consumer has been informed of this, ANTONIO PLA FERRANDIZ may supply a product with similar characteristics without an increase in price, in which case, the consumer may accept or reject it, exercising their right of withdrawal and termination of the contract.

In the event of unavailability of all or part of the order, and the rejection of the replacement products by the customer, the refund previously paid will be made through the same payment method that was used in the purchase.

If ANTONIO PLA FERRANDIZ is unjustifiably delayed in returning the amounts paid, the consumer may claim double the amount owed.

6 PURCHASE AND/OR CONTRACTING PROCESS

To make any purchase at www.antonioplaferrandiz.com, the customer must be of legal age.

The steps to follow to make the purchase are:

7. A “ORDER SUMMARY” appears in which we have calculated the additional transport amount (in the case of not being within the free parameters ” + of 3 Kg.”). Here we have to “CONFIRM ORDER” and accept “GENERAL CONTRACTING CONDITIONS” and “PRIVACY POLICY”.

BILLING

7 DELIVERY

PRODUCTS

The order will be delivered to the address designated by the customer at the time of contracting according to the chosen modality.

The scope of delivery includes the following areas: Peninsular Spain, Balearic Islands, Canary Islands and Europe.

FORMS AND DELIVERY TIMES

1. Pick up in store: (FREE).

We can choose the pick-up in any of the 2 stores. The 1st located in C/Llovera nº26, baixos, 43201, Reus (Tarragona) or in the 2nd Raval Santa Anna nº6, 43201, Reus (Tarragona). Store hours: Every day from 09:00 hours to 21:00 hours.

The maximum delivery time is 10 day/s.

2. Home delivery, through courier/parcel companies.:

Company hired for the transport of purchases: “NACEX” DRONAS 2002, S.L. Unipersonal Sociedad Unipersonal P.I. NORDESTE C/ ENERGIA 25-29 08740 SANT ANDREU DE LA BARCA NIF: B-62745765.

In some orders, the company also provides the transport service: “REUS COMPRA RESPONSABLE” basically in local deliveries.

The maximum delivery time is 3 day/s.

Normally the deadlines are between 24 and 96 hours.

8 PRICES, EXPENSES AND TAXES

The prices of the products that are collected in www.antonioplaferrandiz.com will be expressed in Euros unless otherwise stated and will be guaranteed during the validity period thereof, except for printing errors and whatever the destination of the order.

PRODUCTS

The final prices of all products, (and where appropriate, the final prices per unit of measurement, when mandatory) together with their characteristics, offers, discounts, etc., are reflected in each of the articles that appear in the catalog of www.antonioplaferrandiz.com.

• The products include VAT.
• The VAT rate is 10%.

The prices of the products may vary at any time. In this case, the price to be applied will be the one in force on the date of the order. In any case, the final cost will be communicated to the customer in the electronic purchase process before the customer formalizes their acceptance.

9 FORMS OF PAYMENT

We put at your disposal these forms of payment:

1. By credit or debit card

You can make the payment immediately through the secure SSL payment gateway of our Bank. If it is necessary to make any return or cancellation of the order, the amount will be reimbursed through the same payment card.

1. Cash on delivery

The customer will make the payment in cash at the time of delivery of the merchandise at the place designated by the customer when placing the order.

1. PayPal

Through PayPal, the payment of the order will be authorized, but no money will be withdrawn until PayPal verifies that it is correct. For this, it will be essential to have a PayPal account.

OBSERVATIONS

In case of placing the order by Whatsapp (outside the web/platform) you can pay by BIZUM. OR BANK TRANSFER.

10 RETURN AND WITHDRAWAL POLICY

As established by the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without needing to indicate the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the referred text of the General Law for the Defense of Consumers and Users.

This right of withdrawal is not applicable, among others, to:

• The contracts for the supply of products made according to the specifications of the consumer and user or, clearly personalized, or that by their nature cannot be returned or may deteriorate or expire rapidly.
• Supply of sealed goods that cannot be returned for health or hygiene reasons.

PRODUCTS

The customer will have a maximum period of 14 calendar days from the day of receipt of the good or product requested to inform ANTONIO PLA FERRANDIZ about their desire to withdraw from the contract.

The withdrawal implies that, ANTONIO PLA FERRANDIZ will proceed to the return of the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for its payment (provided that the product purchased is not within the exceptions indicated above).

During this period, the consumer will communicate to the employer their decision to withdraw from the contract by filling out the form found at the end of this document and sending it to the email address of ANTONIO PLA FERRANDIZ.

ANTONIO PLA FERRANDIZ will communicate to the consumer in a durable medium an acknowledgment of receipt of said withdrawal.

To proceed with the return of a product, it is essential that it is in perfect condition and with its corresponding original packaging, with all its accessories and without having been used.

Once we receive your request, we will contact the customer to indicate the details of the return.

The customer will bear the costs of returning the goods.

OBSERVATIONS

The products that have an expiration date with a margin of time (nougat,) are applicable to the withdrawal. Not in the case of ice cream, others similar or other products.

11 RESPONSIBILITY AND EXEMPTION OF RESPONSIBILITY

The consumer and user has the right to repair the product, its replacement, the reduction of the price or the termination of the contract, as established in Chapter II Title. IV Book II of the General Law for the Defense of Consumers and Users.

If the product does not conform to the contract, the consumer may choose between the repair or replacement of the product, both being free for the consumer, which will be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.

If, once the repair is completed and the product is delivered, it is still not in accordance with the contract, the consumer may demand its replacement, the reduction of the price or the termination of the contract.

12 CUSTOMER SERVICE AND CLAIMS

To file any complaint or claim with ANTONIO PLA FERRANDIZ, the customer must contact the customer service department either at the telephone number 977 343013, or through the email address info@antonioplaferrandiz.com.

According to the Resolution of online disputes in consumer matters of the EU and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform that is available at the following link: http://ec.europa.eu/consumers/odr/.

13 APPLICABLE LEGISLATION

The present conditions will be governed by current Spanish legislation.

The language used will be Spanish.
